For injuries on or after July 1, 2026 the maximum weekly rate is $1,281.50 — see the full historical maximum rates table. The minimum weekly benefit rose to $275 on January 1, 2024 and $325 on January 1, 2025, and beginning January 1, 2026 it is indexed to one-fifth of the New York State Average Weekly Wage.

Which rate year applies to my case?

The rate period covering your date of injury. The maximum and minimum in effect on the day you were hurt stay with your case for its life, regardless of later annual increases.

How do the rate caps affect my weekly check?

Your weekly benefit is two-thirds of your average weekly wage multiplied by your degree of disability. If that figure exceeds the maximum for your injury year you receive the maximum; if it falls below the minimum you generally receive the minimum rate.
