NYS Statutory Minimum Rate Schedule (WCL §204)

The weekly benefit rate cannot fall below the statutory minimum for the date of injury. If 2/3 AWW is below the minimum, the rate is raised to the minimum — unless the claimant's AWW is itself lower than the minimum, in which case the rate equals the full AWW. This calculator applies that floor automatically to all TT/RE/TR computations.

About CCP Awards in New York

A Classified Compensation Period (CCP) award is a formal determination by the Workers' Compensation Board that establishes a period of indemnity benefits. Awards are built period-by-period, each with its own benefit type (designation) and dates.

TT — Temporary Total: Rate = 2/3 of AWW, capped at the statutory maximum for the date of accident. Used when the claimant is totally disabled from all work.

RE — Reduced Earnings: Rate = 2/3 × (AWW − current weekly earnings). Used when the claimant returns to lighter duty at reduced wages.

TR — Temporary Reduced: Rate = a percentage of the TT rate, entered manually. Used by stipulation or direction.

TP / NCLT / NME: Manual rate entry. TP = temporary partial; NCLT = no-comp lost time; NME = no medical evidence.

Attorney Fee (WCL §24): The fee on the award equals 15% of the moving (new money) amount. The fee on the CCP is 1/3 of the CCP dollar amount. Both are paid from claimant's award.
