FAQ

Currently, yes. Apart from limited exceptions like emergency care, a provider who treats an injured worker in New York generally must be authorized by the Workers' Compensation Board. Governor Hochul's 2026 "Universal Authorization" proposal would remove that requirement for any eligible licensed provider in good standing, but it is not yet law — if enacted, it would take effect January 1, 2028.
Generally yes. For non-emergency treatment, you have the right to select your own treating physician, who currently must be WCB-authorized. If your employer is part of a Preferred Provider Organization (PPO), you may be required to see a PPO provider for the first 30 days. A WC attorney can confirm what applies in your case.
