Every New York workers’ comp claim travels the same road. Here’s what happens at each stop, and what to do there.
Go to the hospital or a doctor as soon as you can, and tell them you were hurt at work. That first visit starts your medical record.
What to do after a work injuryTell your employer in writing within 30 days. Then file Form C-3 with the New York State Workers’ Compensation Board. You have up to two years, but file as soon as you can.
Start your C-3See a doctor who is authorized to treat workers’ comp patients, go to every appointment, and keep copies. Your doctor’s reports tell the Board how you are doing.
Find a doctorIf the injury keeps you out of work or cuts your pay, weekly cash benefits are based on your average weekly wage: up to two-thirds of it, capped at the state maximum.
Estimate your weekly benefitWhen your doctor says you’re ready, you go back. If the injury leaves a lasting loss, the Board can make an award for it, or the case can settle.
